Invalid Marriages

From the previous ques it’s clear that men shouldn’t marry a woman who goes on dargah or do biddah. My mom and cousins often force me to say yes for a man of the same category, when i refuse (as his family engage in the above mentioned deeds) they say that I’ll be responsible for my kids as a women raise kids not men. Is this right? Should i say yes for such a man?

ANSWER: No, you should not move ahead with such proposals of people with corrupt aqeedah or those committing shirk as the marriage would be invalid if he is committing shirk.

If a husband and wife having fights and have various marriage issues which is not easily getting solved and due to which they are living away form each other. Will their living away from each other more than 6 to 7 months break or cancel out their marriage like Divorce?

ANSWER: No. They are still married even if they live separately for 100 years. The Marriage is only dissolved with divorce or khula.

My mom in law is comng to live with us in ,her daughter lives close by & is married to a Hindu from 10+yrs & they all disagree that her marriage is invalid,she is on video calls with her daughter &grandson most of the time.she would keep visiting here & there & this would create disturbances..is it ok for me n my daughter to live in this environment?

ANSWER: You must forbid your husband to have any communication with his sister’s family as her children are born out of wedlock and the man she is living with is a fornicator as well as she. If she believes that her marriage is valid, she is an apostate.

Does husband and wife relationship becomes invalid if they live apart for more than 15 years with their mutual decison and without giving any divorce or khula??

ANSWER: No, the marriage does not become invalid. They’re still considered as husband and wife.

We all know that forcing a daughter or a female for marrying someone she doesn’t want is haram and the marriage is invalid if she doesn’t approve of it as we know from the hadith of the Prophet PBUH. ANSWER: She doesn’t participate in the marriage from the beginning and tells everyone that she is not married nor accepting it. She should also refuse to go with the man even if she has to call the police.

Sheikh, I wanted to know if a non-practising muslim father is considered to be a Wali or not? Can in this case a nikah be valid and is a consent still needed? Please, if possible, provide the ruling and reference.

ANSWER: He is still her wali until proven that he is a disbeliever or unfit to be her guardian as when he orders her to have boyfriends or to go to nightclubs etc.

I have been asking u about nikah in the sub cont.U said it is not valid.Does that mean everyone one here is living in zina?We have some real scholars here who have not objected to it because the wali gives his full consent.U said renew the marriage contract but i am 16 and cant tell anyone to do it.So can i stay quite about it and just make dua to allah to forgive us all& show us the right path?

ANSWER: If they got married thinking that their marriage is legitimate and valid, their marriage is valid. Once they know the Islamic ruling, they must rectify it and renew the marriage.

I have been messaging my dad (after my mom split up, after 20+) but he never replies to my messages he reads them never replies. I want to get married but how am i without my wali.
