QUESTION: My friend’s husband does shirk. If they get divorced then the judge in India will take it and you know how misguided they are. My friend is afraid if she divorce he will take her daughter especially if she get married as he will ask again. What to do?

ANSWER: If her husband does shirk and goes to graveyards and worships the dead, her marriage is invalid and she must get divorced with him. She must do her best to get custody of the child.

QUESTION: Sheikh, what is the ruling and punishment for a man who has the means but does not provide for his wife and for a man who does not provide for his children (full/proper maintenance) in a divorced home.

ANSWER: After divorce the man is not obliged at all to provide for his ex wife! As for his children, it’s solely his responsibility to take care of all the financial needs of his children even if they don’t live with him.

On behalf of a sister – If a Muslim woman is divorced by her husband and has a young baby under the age of 1, can the father take the child from the mother or is the child better to stay with the mother? They live in the UK.

If the father doesn’t object and the new husband is ok with that, this is permissible.

I have all conditions to give my husband khula but I have a 3 yr old daughter whose custody my husband & inlaws aren’t giving me,they’re rich people.Do you think it’s permissible by Allah swt for me to not give khula for my daughter’s sake?I have done isteqara,didn’t get any answer,but a chain of situations just made me come back with to my husband.

This is a decision you must take by yourself! The custody is yours islamically and even in most countries that are not Islamic.

I have custody of my child and want to move back to my country. I don’t have any family here and living alone here is incredibly hard on me. My parents can only visit once a year. Would it be permissible to leave the country I’m living in now and thus moving away from the father of my child?

This is permissible but you must give him rights to see his child on holidays and to be with him and also to contact him on weekly basis.

In an Islamic country, this would count, as her mother would be awarded the custody of the child if the father is not fit.

When a man and a woman who are married divorce and they have a child, the man must pay for the child and is responsible for it , right? but what if the man wants to move to another country together with his child and the mother doesn’t want to give the child to him, is it permissible then to negotiate that the woman pays for everything alone and both agree so that the father doesn’t have to pay anything? (it was even the mother’s idea)

As long as the woman didn’t marry, the custody of the child must remain with her and the father is obliged to support and provide for his son no matter what country he is in.

Yes, the custody goes to the father unless he allows his ex to have the children and the new husband agrees to that.
