My father wants to disturbed his property in his life so is it allow to divide in life.

ANSWER: No problem, he can gift his property in his lifetime but must be equal in whatever he gives to all of his children.

My father passed on 4 months ago. While we are processing the required paperworks for his estate as he did not leave a will, we want to share and distribute to charity some of his clothes and personal belongings. Can we go ahead with this for now as the paperwork does not affect this.

Sheikh, i wanted to enquire that is it allowed to write will for a women ( Leaving 1/3rd for charity ) of her property for her children specifying what belongs to whom? That is, if she has built 2 houses, can she write specific Will that 1 goes to her son and other to her daughter? And a specific small area thats could be used as a store area for 1 of her child?

According to the law of the land anything bought after marriage is automatically shared ownership regardless who bought it and the name under it. My father bought a house, now that he passed away do the inheritance must be halved first then divided as my mother is still alive eventhough name of ownership is only my father.

ANSWER: It shouldn’t be halved first, If the papers were on his name, the property would be divided between all his heirs, including his wife, according to Shariah. The law of the land has no superiority over Allah’s law.

My mother passed away 7 yrs back due to brain stroke. But just the day b4 she fell ill she told us that if we give any property to one of our sister who did not treated her well n misbehave a lot of times becoz of her husband n in-laws,she will not forgive us . ANSWER: Whatever will she left is abrogated by the sharia and her property must be divided according to Allah’s law whether she instructed against it or not! This is not valid and all her children must get their share as directed by Allah.

We are 4 daughters(no brothers), survived by my mom. According to the shariah, the property has to be distributed to my uncle and 2 aunts. If the property to be inherited is not being distributed according to the shariah, What am I supposed to do? Can I refuse to take the property? Or should I take my share and then distribute from it to my uncle n aunts? Please advise

ANSWER: This must be distributed according to Shariah otherwise there is a severe punishment awaiting those who grab people’s property unjustly. You should try to tell them about Allah’s wrath. Even after this if they don’t listen, you can take your share and give to your uncle and aunts whatever is extra from your share.

Are the children of wife (from her previous marriage) entitled to inherit from her current husband?
