Ruling without the Shari’ah is not always kufr.

The scholars are not obliged to come and tell the public about their advices to the rulers.

Why the scholars are silent when the rulers are not ruling with the sharia ? not ruling with the shariah is also a kufr and shirk then why the scholars are silent?
