Her father or her brother can not act as a wali (the guardian) because they are disbelievers. They can however be present when the man comes to propose so that they would break the seclusion which is not permissible. however, when it comes to the marriage contract, the wali must be the imam, the Islamic judge or a Muslim with some authority in her area.
The Prophet’s (peace and blessings be upon him) hadith: “No marriage contract can be concluded without the presence of a wali. A Sultan (authority figure) can act as a wali for those without one.” (Reported by Ibn Majah and Imam Ahmad)
Narrated Aisha, Ummul Mu’minin: The Apostle of Allah (peace_be_upon_him) said: The marriage of a woman who marries without the consent of her guardians is void. (He said these words) three times. If there is cohabitation, she gets her dower for the intercourse her husband has had. If there is a dispute, the sultan(man in authority) is the guardian of one who has none. (Sunan Abudawud Book #11, Hadith #2078)
