He can’t accuse her of adultery without 4 witnesses. But he can say that she is staying with a Kafir if he has evidences of this and this would be sufficient to strip her of the custody.

My friend & her husband are divorced. They are battling custody of their son (7 years) in court. The husband wants one of his friends to give evidence against the woman saying she is carrying on with a married kafir man. In fact she IS carrying on and it is a known fact to everyone. But as it is a matter that will cause public embarrassment to this woman, is it permissible for the friend to give evidence against her? Pls reply by email
