There are two types of swearing; one is the true real oath one makes by saying wallahi either to confirm doing something or to prevent himself from doing something.

The other type is something that is not intended. This is what is used when people talk about things and they are not intending it such as when someone asks you to sit and have lunch and you say wallahi I am not hungry or I don’t have time.

It is best not to use this a lot because Allah tells us to preserve our oath (Yameen). However, one can’t say a person is sinful if he says that.

I know if anyone wants to swear, he / she should swear in the name of Allah only. Many people, specially in Arab countries say “WALLAHI”. Is it not a sin because swearing in the name of Allah again and again is a sin? Saying “WALLAHI” in every sentence, is it not a sin?
