ANSWER:

The question is not clear! If you want to give your brother a gift while you are alive, you can do that without asking anyone’s permission. 

But if you want to include him in your will which is to be executed after your death, you can’t give him more than 1/3rd of all what you had left behind, providing he is not one of your heirs due to the presence of a son or more. 

I had a house of my own a year ago and have had always planned on given my house and shop inheritance to my younger brother, but now i have sold my house to finance my sons education. Now my intentions are still to give my inheritance to my brother but do i have to ask my children for their opinion as i read somewhere that i have to if I don’t have a house of our own.
