He can give a fatwa if he is qualified to give one.
Faqih is a person who has understanding of the fiqh issues.. Mufti is the grand scholar who gives Islamic fatwa or verdicts.

Can a muhaddith give a fatwa? And what is the role of a Faqeeh and a mufti?
