QUESTION: With regard to gifts..A man has 5 kids but 1 of the child doesn’t follow ONLY ISLAM but follows other religions as well..Gifts are property like flat and shop which the child will share with her hindu mother as parents are divorced and the child stays with the mother and refuses to come to the father?so does the person has to gift equally to that child regardless of what is her belief?

ANSWER: No, because if she believes in other religions then she’s an apostate! Such a child won’t inherit from the Muslim parent

QUESTION: Before my father passed away, he told my uncle he didn’t want a share,But now I am responsible for supporting my younger sisters(I’m 25 already). But now my elder sister wants us to claim our share. Is it rightful to do so?

ANSWER: If your father had documented his withdrawal from inheritance or pledged not to have his share in front of 2 muslim male witnesses then you guys can’t claim it.

QUESTION: After my father’s death we discovered he has a 4/5 yrs daughter from an extramarital affair theres no nikah/marriage certificate only birth certificate naming him as the father. ANSWER: If he wasn’t married to her mother and he had never disclosed it or claimed her to be his daughter, she has no right in anything as she was born out of wedlock and is not related to you.

QUESTION: My father passed away four years ago. As with British law all his money and assets went to my mother. I have asked for this to be distributed according to the Sharia but my Mother and siblings said this will only be distributed after our mother passes away as she is the Mother and has full rights to these assets and can do as she pleases because a mother’s status in Islam is very high.

ANSWER: Yes, it’s a debt on him & this mahr amount (which was fixed at the time of their nikah) must be given to your mum from his inheritance
