ANSWER:

If the property is jointly owned by you and him and you paid for half and he paid for half, this means that he has the right in half of it.

But if you did not pay anything in it and he didn’t give you half of it as a gift, rather he did this only on paper to get the mortgage or for legal reasons, you have no right in claiming anything in it.

You must not pay any of the interest based loan as this is clear riba.

You are better off selling your share if you own half of it to him and let him pay the balance.

He is obliged Islamicly to provide for his children a place to stay whether he let them stay in the house or rent them another property.

QUESTION: Please could you let me know what is the right thing to do about our jointly owned home in the UK after divorce.
