Yes, as this is breaking the laws of the land and she can’t give that child her husband’s name as there is no adoption in Islam. If the child is with its legal papers and named after its father and they give the right of bringing up the child to that family, this is fine but the husband and the males in her family are still non mahram to the child when she grows up.
