No, this is not valid as the niyyah for fard missed Ramadan fasts must be done before the athan of fajr. This is counted as general voluntary fasting.

I made intention to fast one night, but not decided whether its volunteer shawwal fast or Ramadan missed fast till morning. Then I learned that we have to complete missed Ramadan fasts first, then make 6 shawwal fasts.so I intended it my Ramadan fast in the morning.so, is it acceptable? Shall I count it as Ramadan fast?
