My deceased husband had taken an life insurance plan.We had paid an capital amt of INR 10 lakhs in 5 yrs.After his death i got 10 lakh extra on our capital amt.Are me my orphaned children allowed to use that extra money apart from our capital amt.

ANSWER: Yes, you can use it. It’s his inheritance and it must be divided among all his heirs according to shariah law. The person who has taken the Riba based insurance is sinful and not his heirs.

Sheikh, in our community sometimes people have multiple children and during his lifetime he has to spend significant amount of extra money for one or two children for education, giving business support etc. Now when he is old/feeling deathbed he wants to will the other child/children liitle more than those from his property. Is this practice compatible with Islamic rules?

ANSWER: This is totally prohibited and such a will is invalid and must be thrown in the dustbin and inheritance must be divided according to shariah law after his death.

My father passed away, please make dua for him. Most of his life my father did not pray, nor fasted nor paid zakah and accumulated interest on his wealth. Now what should we do as his inheritors first? Will the wealth inherited be halal for us if Zakah and interest is not taken out? How shall we compensate for his fasts? The calcuation of 40 years is hard.

ANSWER: The inheritance is halal for you all as the haram money is only haram for the person earning it and not for anyone else. If he had not fasted deliberately without any valid reason then you must not fast these on his behalf.

ANSWER: No problem in filing a court case against his mother and sisters if they are not willing to follow the sharia rules in dividing the inheritance. This is not disobedience to his mother at all.

I had a house of my own a year ago and have had always planned on given my house and shop inheritance to my younger brother, but now i have sold my house to finance my sons education.
